Terms of Service

1. Purpose

These Terms of Service (hereinafter "ToS") define the terms and conditions of use of the Hekko service (hereinafter "the Service").

Hekko is an automatic lecture transcription and pedagogical note generation service powered by artificial intelligence.

2. Acceptance of the ToS

Using the Service implies full and unconditional acceptance of these ToS. By creating an account or using the Service, the User acknowledges having read, understood, and accepted these ToS without reservation.

3. Definitions

• Service: all features offered by Hekko, including audio transcription, note generation, and revision sheet creation.
• User: any individual using the Service.
• Account: the User's personal space allowing them to access the Service.
• Content: all data, text, audio files, and documents generated or imported by the User.

4. Registration and User Account

4.1 Account creation

To access the Service, the User must create an account by providing a valid email address and a secure password. The User guarantees the accuracy of the information provided.

4.2 Account security

The User is solely responsible for the confidentiality of their login credentials. Any use of the Service from their account is deemed to have been made by the User themselves.

5. Description of the Service

Hekko allows users to record audio content, obtain automatic transcriptions, and generate structured notes using artificial intelligence. The Service offers the following features:

• Real-time transcription: automatic conversion of audio to text during lectures
• Structured note generation: automatic creation of pedagogical notes from the transcription
• Revision sheets: generation of summaries and exam questions
• Course organization: folder sorting and content search
• Contextual chat: AI assistant to ask questions about course content

6. Terms of Use

6.1 Authorized use

The User agrees to use the Service:

• For personal and educational purposes
• In compliance with the rights of third parties
• In accordance with applicable legislation

6.2 Prohibited uses

The following are strictly prohibited:

• Recording private conversations without the consent of participants
• Using the Service for illegal or fraudulent purposes
• Sharing your account with third parties
• Attempting to bypass the technical limitations of the Service
• Using the Service to generate content that infringes copyright
• Intentionally overloading the Service infrastructure
• Mass extraction of data from the Service (scraping)
• Reselling or redistributing the Service without authorization

6.3 Recording responsibility

The User agrees to obtain prior authorization from recorded individuals and to comply with applicable legislation regarding audio recording. Hekko cannot be held responsible for recordings made without the consent of the individuals concerned.

7. Intellectual Property

7.1 User Content

The User retains all intellectual property rights over the Content they import or generate through the Service. Content provided by the User as well as generated content belongs to them. Hekko claims no ownership rights over this content.

7.2 Service Ownership

The Service, including its source code, interface, algorithms, and brand, is the exclusive property of Hekko. Any unauthorized reproduction, modification, or use is prohibited.

8. Personal Data

The processing of personal data is governed by our Privacy Policy.

8.1 Processing of audio recordings

Audio recordings are used exclusively for the purpose of generating a transcription and associated notes. Audio files are not retained and are automatically deleted after the transcription process.

8.2 Hekko's commitments

Hekko commits to:

• Not selling Users' personal data
• Not transferring any data to third parties for commercial purposes
• Encrypting sensitive data
• Allowing data export and deletion upon request
• Complying with the General Data Protection Regulation (GDPR)

9. Pricing and Subscriptions

9.1 Plans

Hekko offers a free plan with limited features and paid subscriptions (monthly or annual) with extended features. Current pricing and features are available on the pricing page.

9.2 Payment

Payments are made by credit card through a secure payment provider. Payments are due in advance. Any subscription period that has begun is due in full. Subscriptions are automatically renewed unless canceled by the User.

9.3 No right of withdrawal

In accordance with Article L221-28 of the French Consumer Code, subscriptions providing access to digital content or an immediately delivered service do not give rise to a right of withdrawal.

No refund may be claimed in the event of:

• Non-use of the Service
• Early termination by the User

9.4 Cancellation

The User may cancel their subscription at any time from their personal space. Cancellation takes effect at the end of the current subscription period, without refund.

10. Limitation of Liability

10.1 Service availability

Hekko strives to ensure Service availability 24/7. However, Hekko does not guarantee uninterrupted availability and cannot be held responsible for temporary interruptions.

10.2 Transcription accuracy

The Service is provided "as is". Transcriptions and AI-generated content are provided for informational purposes only. Hekko does not guarantee their absolute accuracy and recommends that the User verify them.

10.3 Limitation

Hekko cannot be held liable in the event of:

• Transcription errors
• Data loss beyond its control
• Non-compliant use of the Service

Hekko's total liability is limited to the amounts actually paid by the User during the preceding 12 months.

10.4 Service interruption or discontinuation

Hekko reserves the right to interrupt or discontinue the Service, particularly in the event of business cessation, major technical difficulties, or force majeure. In the event of permanent discontinuation of the Service before the end of an annual subscription, a pro-rata refund of the unused period may be issued.

11. Modification of the ToS

Hekko reserves the right to modify these ToS at any time. Users will be informed of substantial changes by email or notification within the Service. Continued use of the Service after modification constitutes acceptance of the new ToS.

12. Termination

12.1 By the User

The User may delete their account at any time from their account settings. This deletion results in the permanent deletion of all their data.

12.2 By Hekko

Hekko reserves the right to suspend or delete an account in the event of:

• Violation of these ToS
• Fraudulent or abusive use of the Service
• Non-payment of amounts due

13. Applicable Law and Jurisdiction

These ToS are governed by French law. In the event of a dispute, the parties agree to seek an amicable solution. Failing that, the French courts shall have sole jurisdiction.
